Terms of Service

1. Nature of Service and Platform Role

LK Criações Web, trade name of 48.844.509 Lucas Mateus Lopes, registered under Brazilian CNPJ 48.844.509/0001-47, operates strictly as a Software as a Service (SaaS) technology provider, offering website creation, digital marketing, and technology solutions for businesses ("Clients").

For EU users: we act as an "intermediary" under Regulation (EU) 2022/2065 (Digital Services Act — DSA). For US users: we claim protections under Section 230 of the Communications Decency Act and DMCA Safe Harbor (17 U.S.C. § 512).

2. Acceptance and Eligibility

By accessing or using the Platform, you represent that: (a) you are of legal age (at least 18); (b) information provided is truthful and current; (c) you are authorized to bind the entity you represent; (d) you are not prohibited by law from receiving the services; (e) your account was not previously suspended for violating these Terms.

3. Services, Plans, and Availability

LK Criações Web offers website creation, digital marketing, managed hosting, and a SaaS platform with AI agents. We reserve the right to: (a) modify features with 30 days' notice; (b) discontinue features with 90 days' notice; (c) perform scheduled maintenance with 24 hours' notice. Target uptime SLA is 99.5% per month, excluding force majeure.

4. Payments

Fees are charged per commercial proposal or subscribed plan. Non-payment within 7 calendar days results in service suspension; after 30 days, account cancellation. For EU users, prices include VAT where applicable. EU consumer right of withdrawal (Directive 2011/83/EU) applies per our Refund Policy.

5. Intellectual Property

LK Criações Web and all Platform elements are protected by applicable IP laws, including Brazilian Copyright Law (9.610/1998), Industrial Property Law (9.279/1996), DMCA (USA), and Directive 2019/790/EU. Custom project source code belongs to the Client after full payment, unless otherwise specified.

6. Data Protection (LGPD/GDPR)

Data processing is governed by our Privacy Policy. LK Criações Web acts as Data Processor (LGPD Art. 5, VII / GDPR Art. 4(8)) for Client end-user data, under the Client's instruction as Data Controller.

7. Limitation of Liability

To the maximum extent permitted by applicable law, LK Criações Web shall not be liable for: (a) indirect, incidental, special, or consequential damages; (b) loss of profits, revenue, data, or goodwill; (c) third-party failures; (d) Client-generated content; (e) force majeure interruptions. Total liability is limited to fees paid in the preceding 3 months.

EU/UK consumers: nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federative Republic of Brazil. For Brazilian users: the courts of Florianópolis/SC shall have jurisdiction. For international users: disputes shall be resolved by ICC arbitration in Paris, in Portuguese or English.
